FC: Jerry Sandusky to attempt another appeal using secret testimony

Jerry Sandusky intends to use secret Grand Jury testimony in attempting another appeal on his conviction of 45 counts of child sex abuse.
Materials regarding the former Penn State football defensive coordinator's appeal will be filed "in the next several days," according to a motion filed Monday requesting the court allow Sandusky to file Grand Jury testimony as part of these impending materials.

I'm confused.

If there was potentially exculpatory testimony or other forms of evidence presented to the Grand Jury, wouldn't Sandusky's defense have access to them through discovery? If they didn't know about the existence of this material in preparation for the trail, how do they know about it now?

That was my recollection. The prosecution dumped a bunch of discovery material on the defense team's laps at the last minute. Then of course the judge didn't grant the defense any continuance requests for more time to properly review the material....

At the post-sentence motion hearing, the following exchange occurred on cross examination regarding the trial court's refusal to grant a continuance:

"Q: What item have you discovered since the conclusion of your trial, in review of these voluminous documents that you have talked about, that would have altered your conduct at trial?

Amendola: The answer is none.

Q: None. So there is no item, document or person that in your review of the documents that you received at any time that would have altered your conduct at trial during the course of the trial; isn't that correct?

Amendola: That's correct."


With what we now know about Rominger and Amendola's white flag waving exchange above, Sandusky's new attorney must have found something in the Grand Jury transcripts that Amendola and Rominger missed If that's the case, will it even matter?

i suspect they found more than a few things

amendola was a joke. that part of the fix was in.

is jerry guilty? probably. but did he have adequate representation.. imo, not even close. he was rail-roaded in on the pole of public opinion and there wasn't a damned thing anyone was going to do to stop that freight train.

times have changed, the furor has died, and cooler heads might actually be open to listening to what a competent attorney has to say. we'll see.

again, i have little doubt of js's culpability, but what happened in that kangaroo court suggested a great fear that he could walk on a technicality and there was no way they'd allow it.

my greatest concern is that everyone gets a fair trial so, hopefully, no innocent man sees the inside of prison... ever. considering how many innocent men have had their lives destroyed buy over-zealous retards masquerading as doing public service, anything that solves that mess is welcome (by me).
