No trial date to be set for the Paterno suit v. NCAA until late 2016. They cited documents coming from Centre Co. Courthouse. If they're not even contemplating setting a trial date for more than a year from today, this IMO could drag on another 3-5 years, easy.

It's just ridiculous that judges allow this stuff to flounder around forever.

Unfortunately, by that time, whatever the outcome will be back page national news and not have enough momentum to change opinions that were formed long ago. Memories and interest are fading and outside of PSU community, not many seem to care anymore.

The court system is a complete joke. There is no way that C/S/S trial date has not been set, and now this. And I agree that it's too late to matter in so far as the public's interest is concerned. I blame the media most for not pursuing any of the stuff that is out there and putting the pressure on the state. I've just about given up.

Not shocked in the least. No of someone who fought a dui charge for nearly 7 years before being convicted. Wasn't a rich person either. Just knew the system.

Happened in college, would have hurt his career if convicted when originally charged. However, with it 7 years in the past no one cares anymore.
 
It is no longer sensational, so the media does not pursue. I agree the media is to blame but that's their business model, I guess. The court system though, I do not understand why it takes so long. Clearing Joe's name was one of, if not the reason why the family started the legal action to begin with. So, does that not mean anything to the court? NCAA seems to win in the end, regardless of outcome. Hopefully Emmert and Ray have a big check to write when this is all over.

This will be in the news before then, because by then they will need to either try CSS or drop the charges. That will create some flurry either way.

It will be front page news when some pretty high-powered people (Louis Freeh, Ken Frazier) are exposed.
 
Have to say I've always thought highly of Tim Curley. My wife saw him at a tailgate on homecoming weekend (she knows him), and the poor guy has had some serious health issues. But he keeps on pushing ahead.
 
We will have news the first week of November as Senior Judge Howsare has agreed to rule in the Plaintiff Trustes effort to access the Frreh Source Material.

All filings have been made so now we wait.

Most civil suits take a minimum of 2 years to get to trial, and many times more like 3 or 4. This case is high profile and complex. It should be no surprise that it is dragging on. The valid complaint here is the pace at which the criminal matters have proceeded.

It not the state's fault for the C/S/S trial delay. It the motions by C/S/S that holding it up.
 
There's a "truthy" sounding comment.

Wouldn't it be more accurate to say that the state has been less than forthright in answering the accused's motions for additional information? I admit I am not a lawyer but it seems to me that they delay has been in part caused by the prosecution and the judiciary in the way they have responded to motions and the way they handled/mishandled Ms Baldwin's role.
The delay is not about additional information. The lower court already ruled on the motion about Baldwin testimony. The latest round is caused by C/S/S appeal of the lower courts ruling in the matter.
 
No, it's the fault of judge who refuses to issue rulings.
Has there ever been a ruling on C/S/S being charged with a law that didn't exist at that time of the "alleged crime." Or, has there ever been a ruling on the statute of limitations question? Those seem to be very basic, but important, rules of law.

The court should rule in a timely manner.
But then again, PA courts appear to be run by porndogs who have other things on their minds.

C/S/S are anxious to clear their names. However, they will not allow the OAG to trample their constitutional rights.
The PA judiciary, which is full of perverts who where exchanging porn with Frank Fina (the guy who cooked up this ridiculous case), is deliberately dragging it out.
The PA judiciary is probably the most corrupt judiciary in the entire country. FFS - PA justices ignored reports of misconduct in Luzerne Co (which was eventually prosecuted by the Feds as Kids for Cash).

The lower courts haven't ruled on a lot yet. They did finally rule on Baldwin but IIRC they pretty much said- 'this is my ruling. You're going to want to appeal that'. Let's not pretend these delays are simply because of the defense. ;)

Then I doubt it ever gets tried. It will drag out another 8 months to a year and be dropped.
 
Everybody knows it is not going to trial. The state hasn't figured out how to gracefully make it all go away.

Although, maybe they just are hoping that if they hang on long enough, maybe they will outlive the guy who knows a lot about what happened.
