Regarding the Jess Stairs lawsuit and board reform.

With the board reform package that was passed last November (which can be reviewed at this link), does the outcome of the Stairs lawsuit still have significance relative to the "controlling majority"? Potential governmental intervention aside, that is.

Obviously any/all additional support for the Alumni Trustees is a good thing. But it seems to me that with the passing of the "A+" package, the cabal succeeded in depriving the trial of any practical significance. What am I missing?

I think you have the gist of it.

From a "practical" standpoint - ie, "does getting Stairs on the Board have any real impact on breaking up the cabal"...the answer is no.

The Stairs lawsuit does, however, provide another opportunity to illuminate just how FUBAR the governance structure is....which MAY lend support to what is required to break up the cabal - intervention by the legislature.

I won't go into all the ways that the Ag Elections are (and have been for some time) a sham....its been discussed at length here before (and most folks didn't seem to care much).....but the degree to which this lawsuit can bring some of that stuff to light is all good.

I hope that Stairs takes this lawsuit all the way to trial - even if they relent and give him his seat on the Board (which they - the cabal - may very well do - in order to try and short circuit a trial) because bringing it to trial provides the opportunity to illuminate some of the malfeasance - which is the real issue. "Just" getting Stairs on the Board - in and of itself - has limited impact (and the cabal certainly knows this).

All that said, Stairs deserves the seat, and I hope he gets it.

As "A+" CLEARLY showed, without legislative intervention, the OG BOT will simply change the rules whenever necessary to maintain control.

"A+" was crammed down for one reason and one reason only - to maintain control for the cabal....and if we care about PSU we should all recognize it for what it is. "A+" was crammed down because:

1 - The existing BOT prior to "A+" was comprised of 30 voting members.

2 - With 9 elected trustees, the Cabal maintained a 21-9 majority control.

3 - Once it became evident Wolf was going to defeat Corbett (started to become a clear likelihood in late summer 2014), the OG BOT became VERY afraid.

4 - Once Wolf was inaugurated, the OG was going to lose control of the 3 PA Department Secretaries seats (remember, one of their first attempts was to remove voting privileges for these trustees...as well as to reduce the number of elected trustees from 9 to 6).

5 - When the OG BOT got huge blowback from some of the folks in the legislature (which - as I understand it - may have included Corman....which is another interesting story for another day), and later from Governor elect Wolf, they revised their plans - moving from "A" to "A+"

6 - "A+" was "A" dressed up in a different suit, with the same intended result,,,,,,"A+" simply added more appointed sycophant seats (PSUAA Past-President? LOL), to counteract what could have resulted in loss of their majority control. Without A+, the 9 elected trustees would have been joined by the 3 Department Secretaries and (in time) with six new Governor appointees from Wolf. The cabal would have then had control of just 12 of the 30 seats.

The potential loss of control is so devastating to the cabal, that they crammed down the completely illogical, unethical sham of "A+" to maintain control. Period. They had to do this before Wolf took office (which they did in November of 2014 - the last meeting date before the inauguration).

Pitiful.

Good points, all. Thank you. On the matter of going to trial, ...

Unless Mr. Stairs truly shares our goal of illuminating the corruption (and I haven't seen any evidence to suggest this is a reasonable assumption), I would fully expect him to agree to a settlement package that included seating him.

IMHO the only way this has snowball's chance in hell of going to trial is if someone(s) volunteer to fund it.

And just to be clear: I absolutely hope it goes to trial.

Also, far be it for me to wish to impose MY wishes on Stairs. He certainly has no obligation to take this any further than he wants. Already, he has - I am sure - gone through significant time, effort, and money to stand up for his rights.....BRAVO for him!

The degree to which his efforts further the cause of illuminating the issues we face....all the better.
