Good to see some movement. Superior Court argument tomorrow, should expect an opinion sometime in the fall, and potentially an appeal to the Supreme Court to follow - I used to think that Kane couldn't afford to tank this case and have her political career survive, but I think it's possible now that if C/S win at the Superior Court level that Kane won't appeal to the Supreme Court and let the case go; she's essentially a lame duck at this point, so she may as well fulfill a campaign promise. If the Commonwealth prevails, we'll certainly see a Supreme Court appeal.

Has anyone heard anything about Judge Hoover? If his health is such that he can't return to the bench, I can't imagine things would be expediated.

Hey Dukie, inching is an appropriate description. Nope, not going to the CSS appeal hearing. I think they they have 2 days allotted so they probably expect to cover a lot. It should be interesting. And I don't care which case(s) brings out the most truth, just that it comes out.

Personally, I'd prefer that Baldwin's GJ testimony not be thrown out just so she eventually has to take the stand (but maybe that'll happen either way). But each of CSS has an amicus brief filed by the PACDL that looks pretty compelling.

Based on her GJ testimony, it doesn't appear that Ms. Baldwin had anything terribly damning to say. But given the other BS in this whole mess, who knows what kind of sh*t will be cooked up if this gets to trial.

Never once Lundy other than when mike was put on leave Sunday night after Nebraska game. That was a five minute hr thing for leave.

For those interested, the three cases (C/S/S) are 9th/10th/11th on the docket tomorrow. The court commences at 9 am. Each side is allotted 15 min to make his argument so this will be completed tomorrow.

For those attending, remember the court is in the Capitol Building on the fourth floor.

I'm looking forward to this.

Well if CSS have what amounts to unlimited resources that's a good thing since it will ensure a more even playing field as the government always has unlimited resources.

Barring a miraculous recovery Judge Hoover is not expected to return to work. At some point the case would be transferred. That said, for the sake of the Judge and his family let's hope for that recovery.

I do not believe so Dukie. There may have been a hearing for which another Judge was assigned (Judge Cherry, IIRC) but I don't believe that was a permanent assignment of the case.
 
The more I think about this I can't help but believe that the timing of the Kane indictment and resignation is just another way of upsetting the timeline for the case schedule listed above.

Im not a lawyer by any stretch....it's just that over the last few years I have developed an acute sense of smell for rats.
If anything has been upsetting the schedule, it was Kane's firing of the appellate attorney that was going to argue the cases - I don't think Kane's arrest has disrupted the process too much. Kane hasn't resigned, fwiw. The Superior Court has its own schedule, and nobody - prosecution, defense, or appellate court - seems to be in too much of a hurry.

Wouldn't oral argument be behind closed doors since all the briefing was filed under seal (due to GJ matters)? If you're going to have oral argument open to the public, why seal everything?

Spanier's lawyer filed a request for stay (i.e. stop everything) which was rejected immediately along with an order that no requests for extensions be filed (appellate courts routinely grant extensions). We could have a decision by the middle of September, which would be very fast, even for an interlocutory appeal.
 
Not once that I am aware of.... Just the leave meeting after Nebraska game.

Is it normal that the document filed by PH is this short? I expected it to be full of reasons as to why the court was wrong, not just a list of things. Less than 2 pages are anything but headers and peoples names and addresses.

I wonder how "the court" feels about "the court erred" in every decision "the court" has made correctly about the lack of ACP. Bunch of fukktards on Freeh's side of this.

It seems disingenuous in the least. I'm not familiar court cases, and I do imagine this sort o' crap is common, but I wonder just how effective is this sort of thing. How often does the judge respond to this sort of filing by essentially saying, "Derp, boy I really screwed up those rulings. Looks like you guys totally busted me, though." I'd think the general response from the judge would be, "Oh, you think I erred. How about you drop dead." Any lawyers want to straighten me out on this?

It seems disingenuous in the least. I'm not familiar court cases, and I do imagine this sort o' crap is common, but I wonder just how effective is this sort of thing. How often does the judge respond to this sort of filing by essentially saying, "Derp, boy I really screwed up those rulings. Looks like you guys totally busted me, though." I'd think the general response from the judge would be, "Oh, you think I erred. How about you drop dead." Any lawyers want to straighten me out on this?

The phrase "The court erred..." is standard phrasing used in all appeals in conformance with Rule of Appellate Procedure 1925(b).
