Sandusky Accuser's Atty Faces $3M Abuse Settlement Suit
By Matt Fair

Law360, Philadelphia (June 6, 2017, 2:44 PM EDT) -- One of ex-Penn State University assistant football coach Jerry Sandusky’s purported sex abuse victims filed a $2.8 million lawsuit against his former attorney on Monday, alleging that he was plied with alcohol and coerced into signing a settlement that significantly undervalued his molestation claims.

A malpractice complaint lodged in the Philadelphia County Court of Common Pleas accuses Albert Torrence, an attorney from Beaver County in western Pennsylvania, of taking then-client Stephen Milbourne to a bar where, instead of being walked thoroughly through the settlement offer, he...

LOL, so he blew all his money and wants more. Ahhh to be plied with alcohol.

Never understood the rationale of giving money to these "abuse victims" anyway. Wouldn't all of the material fortunes gained from these settlements just be painful reminders of the horrific abuse the victims encountered? Wouldn't just paying for counseling be a more appropriate settlement? I would venture to guess that the number of "victims" getting a settlement might be a bit lower if that were the case. Just a hunch.

With so many nonvetted people being paid out of the PSU coffers, why not go for a double dip? What frightens me is that we've devolved into a society where such free handouts are so easily accessible. I don't know if Jerry abused this specific person or not, but here's the thing - neither do the CYA-first "leaders" at Penn State who signed the checks.

Sandusky Abuse Victim Says Lawyer Got Him Drunk So He’d Sign Settlement
By Victoria Taft

Just when you thought the whole, horrific Penn State sex scandal chapter was closed with the sentencing of three of the top university officials over the last two weeks, another odd case has bubbled to the surface.

Law 360 reports that a man who claims Jerry Sandusky molested him now is going after his attorney for selling out his claim. But the reason behind it is anything but routine

The alleged victim, Stephen Milbourne, says that his attorney convinced him to settle his case for much less because he was drunk when he signed the papers:

A malpractice complaint lodged in the Philadelphia County Court of Common Pleas accuses Albert Torrence, an attorney from Beaver County in western Pennsylvania, of taking then-client Stephen Milbourne to a bar where, instead of being walked thoroughly through the settlement offer, he was given alcoholic beverages until he was unable to make a reasoned conclusion about the deal.

The legal journal reports that Milbourne’s malpractice claim asserts the attorney took the victim to a bar where he was coerced into signing the settlement that “undervalued his molestation claims” and was “legally incompetent” to sign the deal.

He is suing his former attorney for $2.8 million.

Law 360 reported that Milbourne retained his lawyer after the notorious case burst into the news:

Milbourne said he retained Torrence in 2012 or 2013 to represent him as he pursued sexual molestation claims against Penn State and Sandusky, but that the settlement he was ultimately presented with offered a cash award that ended up being significantly less than the amounts received by other alleged victims of the ex-coach.

But after signing the papers, Milbourne reportedly changed his mind only to be stiff-armed by his attorney whom, he claims, refused to take his calls. Law 360 reports that the episode sent him into a downward spiral of substance abuse.

The Philadelphia Inquirer reported that a mediated settlement with 30 victims left Penn State on the hook for $93 million in claims. That means each of the victims received somewhere in the neighborhood of $3 million. Milbourne is suing his former attorney for $2.8 million. His lawsuit doesn’t specify the amount for which he previously settled.

Geez if he would have only blamed his substance abuse on Joe he probably could have gotten another cool Mil or 2 from Ira.
Kudos to him for having the stones to blame his attorney.

In the Diocese of Boston sex scandal, 552 victims shared $85,000,000. The individual awards varied from $80,000 to $ 300,000, based on length and severity of the abuse.
The Pennsylvania State University paid 33 victims $93,000,000.
Why the huge disparity in settlements?

Because the kids in the Boston Archdiocese case actually went to court, presented their case, and received a verdict that the Diocese was "guilty" and liable.......
Whereas in the PSU case that never even came close to happening.

So - of course - it is only reasonable that the "Boston" cases had MUCH higher payouts than the "PSU" cases.

Obviously - even a complete idiot would recognize that!

Oh...... uh...... wait a minute.

"Houston, we have a problem"

I'll have to get back to you on that one

Does this dumbass not realize that it's in the attorney's best interest to get the greatest amount possible for his client, as it increases his cut? Should have said you wanted the Freeh docs, dope.

So is anybody complaining that a poor, poor victim's name has been released to the public? Anybody know which number Milbourne is, and what his story was?

Might as well claim to be V2 and go after that money left on the table.

He's been using the settlement money for herion?

Happens all the time. Lawyer/client wins money and other lawyers come sniffing around to try and get a piece of it (because now the money is guaranteed to remain in a trust account). Not very hard, just convince the injured party that they didn't get a fair number from their current counsel, threaten malpractice, and off to the races you go.

Not just kids from crappy backgrounds. Windfall money events tend to make a lot of people do really stupid things.
Possibly, but I don't think I would make up a story about a man who did so much for me and say he molested me. Then again there were so many that this whole idea that the money did this in every account is just silly.

The turds were already caught on the BoT admitting there was no vetting for credibility only negotiated payments. What could they be hiding?

Yea....right:

Or....we could go right to the words of the "Settlement Expert"....Feinberg:

"It took months to resolve some cases. The point of contention, he (Feinberg)said, typically was the amount, not whether abuse had occurred"

"It appears as though Penn State made little effort, if any, to verify the credibility of the claims of the individuals," Eric N. Anderson, a lawyer who has handled cases of sexual-abuse allegations, said in a report of expert witness testimony released with the documents Tuesday."
_____________

"Feinberg said more than the merits of an allegation was considered in determining a case's settlement value.......another was the quality of the accuser's lawyer, Feinberg said."
_____________

"The mediators hardly ever met with the victims, Feinberg said. He and Rozen met with their lawyers, then met with Penn State lawyers to update them on progress."
_____________

"Penn State's board of trustees gave members on its legal subcommittee authority to oversee the process and apprise the rest of the board.

Feinberg said he met with subcommittee members in Philadelphia and gave them details on individual cases. He said settlement values of individual cases were discussed as well as demands."

____________

But...yea....you're right.....its a conspiracy theory.
