That accounts for the seeming inconsistency between the finding of a failure to report but no conspiracy (an inconsistency that the defense may well raise on appeal). As for the intelligent part, it is fairly common for judges to heap praise on the jurors, and the jury did ask some inciteful questions during their deliberations.don't want people know how the sausage was made! Can't justify it so don't talk.

I'll bet if the jurors were the ones being tried they wouldn't be happy with a 'compromise' verdict if they knew they were innocent.
