So Petrosky reports the janitor incident in March 2011. OAG interviews Calhoun, the witness in May 2011. Calhoun says no, it wasn't Sandusky. OAG tells the defense Calhoun has dementia, and Amendola doesn't ask them to prove it.

AM, who claims he is V2, goes on record stating no abuse ever March-Nov 2011. March 2012, says he was abused on trips. A week later says he was only abused in Lasch. His civil attorney then won't let the police speak with him. AM later speaks to private investigator and says never any abuse. AM will testify if evidentiary hearing is held.

Police in V4 case caught lying on tape should have led to mistrial.

And lots of other info about right to fair trial, negative publicity, and more bashing of Amendola.
 
I just read it and there is some troublesome stuff in there. JimmyW and Blehar already ripping it apart. I'm not sure what to make of it, but should be interesting to see how ruling goes. I think it clearly shows Amendola was way over his head, he knew it, and even tried to recuse himself, but judge denied it. The takeaway is to find competent and well resourced defense lawyers. If you can't afford it, you are screwed.
 
It also shows the police and prosecution were going to great lengths to get Jerry. Seem they believed he was guilty and were trying any tactics, including leaks to Ganim, coercing witnesses, embellishing testimony, and downplaying contradictory information, to make a case.

Seems that Eschbach wanted the GJP in March 2011 with the hope that more victims would come forward. Fina wasn't sure the case against AF was strong enough, so he wanted more victims before the GJP. Interesting role Ms. Ganim played (if true).....

Rominger objected as it blatantly violated Sandusky's 5th amendment rights. But, he failed to offer a remedy, such as a mistrial. Had Rominger offered a remedy and been denied, Superior court could have awarded JS a new trial based on his right to the 5th being denied. Thus Sandusky's new attorney argues, JS had ineffective counsel.

Do any attorneys on the board think there is a chance of a new trial? Regardless of its merit, I doubt any judge would have the fortitude to award such.

Asking that all charges of V3 thru v10 be thrown out, as those Vs were discovered after an illegal GJ leak to Ganim; requesting new trial on V1 & V2.

Alleging those leaks were prosecutorial misconduct and requesting a hearing to examine the nature and extent of the leaks.

Despite everyone knowing JS is guilty, every citizen still has the right to a fair trial. I mean look how much time it to Boston Marathon bomber Tsarnaev to get to trial compared to how long it took JS. With the vast amount of evidence they had, they could have put Tsarnaev on trial the week after they captured him, but yet how many years did they give him to prepare his defense?

I do not believe that sandusky is innocent of all charges, but he definitely deserves a new trial. His trial was a sham from the start.

It still boggles the mind that sandusky, with multiple alleged victims and charged with 48 counts, could be tried and convicted just seven months after being indicted, but Curley, Schultz, and Spanier, charged with lesser offenses, are still waiting for their day in court years later (over two for Spanier and over three for Curley and Schultz). We can't even get a ruling on the statute of limitations for the failure to report charge. Unreal.

This exactly. JS was charged with what 45-50... counts of the most heinous and vial acts. Testimony and charges dated back years, and alleged victims were scattered all over the State and all over the region. Some footwork and investigation into charges had to be researched going back 10-12 years. Yet, Sandusky's trial was turned around and started within 4-months. No one sees a problem with the rush to trial? 4 months?? Your example of Tsarnaev is excellent. They had this guy on video tape ... VIDEO TAPE. They had eye-witness testimony. They had eye-witness accounts from multiple Police Officers who saw him shooting at them and saw him removed from the boat. It was a 1-time isolated incident. Yet, with all of that irrefutable evidence, it took a couple YEARS to bring him to trial in order to allow his defense team proper time.

I am not saying JS is innocent. I am just pointing out the blatant and obvious rush to trial that no one seems to question. No one seems to ask "why was JS's trial rushed thru so quickly?".

As much as we all want to vomit at the thought of what Sandusky MIGHT have done to those little boys. He was/is still a US Citizen, and unless we want to just throw out our Constitution, EVERY citizen has the right to a fair & impartial trial.
 
If granted a hearing, it's going to be a who's who on the expected list to testify:

Amendola, Rominger, Fina, Eshbach, Corbett, Ganim, McGettigan, Sassano, Allan Myers and others. With those named on this list and serious allegations of prosecutorial misconduct, I expect absolutely nothing to happen, as has been par for this whole mess.
 
I personally believe that there were forces throughout the state politically that wanted to make sure that this trial was completed before the next football season. Which also coincides with the completion of the freeh report and ultimately the NCAA sanctions.

What entity ties all of those things together, the BOT. I understand the feelings and thoughts that people have regarding John Ziegler but there are a lot of things that he has uncovered that has got to make you at least pause and say " hmmm that's interesting".

No one wants to say JS is innocent because it is not popular or it is tough to put yourself out there like that. But man does it seem like he got railroaded at trial, by things the prosecution did or the lack of time or ineptness of the defense.

But in his own way, the 28-year-old man known as Victim 4 told a riveting story in the first day of Jerry Sandusky’s child sex abuse trial.

On the stand for nearly four hours, he told jurors about how he came to meet the fallen Penn State football legend, and how their relationship quickly branched into two weirdly different directions.
There was the public face of Sandusky, the champion of troubled youth and Joe Paterno’s longtime defensive coordinator.


Publicly, a mentor with a sterling reputation was exposing the troubled kid to a life the boy could never have imagined. Sandusky allowed him to rub elbows with Penn State football players.


And then there was the private side, the man said, one filled with increasingly uncomfortable after-hours encounters in the coaches’ shower room on the Penn State campus.


It was there, Victim 4 told jurors, where he unwittingly traded his innocence because it’s what his “father figure” wanted.


At first, he testified, he was too scared to speak about these strange experiences. But eventually, he conceded, he kept silent because he had become infatuated with the perks.


He gained sideline access at Nittany Lions games — the biggest show in town. He received trips to bowl games. Clothing, shoes and sporting equipment.


Finally, he testified that he was worried about his reputation at school. In his eyes, the loss of face with his classmates might be worse than the acts themselves.


So he played the game.


“It was never talked about. Ever,” Victim 4 said.


He described the post-workout showers. He said they progressed in a matter of weeks from naked bearhugs and wrestling matches to slow caresses with the mentor guiding the boy’s hand all over his body.


Ultimately, it progressed to Sandusky compelling the boy to perform oral sex on him, he testified.



“It was basically like, whatever happened there, never really happened,” Victim 4 said.


He was the first witness in Sandusky’s trial. Victim 4 is likely to be one that the prosecutors from the state attorney general’s office consider to be among their strongest.

Another witness, Alleged Victim 3, testified Thursday that Sandusky would touch him inappropriately during showers and overnight stays at the former Penn State coach's home.

He testified that he was part of Second Mile and that he stayed overnight at Sandusky's home "more than 50 times." Sandusky often came downstairs where he was sleeping, he said.

"He would ask me why I would want to sleep with all my clothes on, so eventually I'd be stripped down to my underwear," said the man, now 25. "He'd jump into bed with me, start tickling me, blowing on my stomach and pelvis. He would also, at times, touch my penis."


Asked if he told Sandusky to stop, he said, "No. I was enjoying the things I was getting too much," referencing trips to football games and favors from Sandusky. "He made me feel like I was part of something, like a family," he said. "He gave me things that I had never had before. ... I loved him."

The accuser said he started going to the Sandusky home when he was about 12 and stopped going in 2009. He said he met the defendant a few years before while swimming at a summer camp sponsored by Second Mile, the charity founded by Sandusky. "He seemed nice," the witness said of Sandusky.

When asked to identify his attacker, the witness pointed to Sandusky without looking at him.

"I don't want to look at him," he said.

Jurors earlier Thursday heard from two other accusers and a police officer and an investigator.

Judge John Cleland indicated he expected the commonwealth of Pennsylvania to conclude its case in the afternoon, but that was not the case.

No proceedings are planned for Friday; the trial will resume Monday.

During testimony Thursday, Alleged Victim 9 said that Sandusky went from presenting gifts to hugging him and kissing him. He told his mother about it, saying Sandusky was a "touchy-feely type of person, that's all."

The physical contact escalated, the accuser said.

"He started getting physical, had me touch his penis and stuff."

I'm saying there is no physical evidence, cops telling kids to lie (on tape), cops lying on the stand and getting caught, guilty charges where the victims say nothing happened to police, and convictions with no witness, no evidence AND no victim. That is insanity.

Questioning this doesn't make anyone a jerry supporter. I question how this is possible in any courtroom.

Sorry I don't care if JS only did 1 count or 50, its all the same to me and he is where he belongs.

I agree that Sandusky is with 99.9% certainty a monster but I also have great concern that the methods employed in a kangaroo court system can be turned on any citizen or entity. That should scare you as an American, maybe just as much as Sandusky. I think he should get a fair trial and that would with almost near certainty still have him facing convictions that keep him behind bars for life. But at least the courts are kept honest.

He won't get out or be found not guilty, but everyone has a right not to be tried in a kangaroo court, such as the circus show that centre county put on.

Do you realize how many victims of abuse deny it initially due to embarrassment? Do you realize how hard it is for some of them to ever come forward?

I know you need the DNA and video which sounds great and all, but you are going back 10+ years in many instances. It's ok to call a spade a spade and Jerry molested children and did it often. He hid behind his nice guy persona and used his charity to cherry pick easier targets. People were all about the Clemente report when it came out as it pretty much vindicated Joe, but it also said Jerry was in the top 1% of pedophiles. He was a master at it. That is from a man who investigated over 1000+ cases of this, but a few here believe JZ over him because he can shoot a hole in 2-3 victims, but really offers no proof of Jerry's innocence. Blaming everyone but Jerry. The judge, his lawyer, the victims, his wife, his son....Jerry was just a good guy who got framed because the world wanted to bring him down.

Yep and it basically pleaded with the victim to come forward which again doesn't make Jerry innocent. Cops have to do this quite often with victims of rape too, but it must mean the rapist are all innocent. Blame the courts, blame the victims, blame everyone but the pedophile.
 
Yes. All 9 are lying Lajolla. As an adoptive father of an 8 year old child of a disfunctional, neglective, abusive start to life, I experience lying regularly. About the simplist things. Put a million in front of the child and the child would never break. Story would change and lie would be suspected as these 9 witnesses change theirs, but mine would never admit the lie with $ in play. Yes. All 9 lied.

If he got dementia and he told his friend prior that you raped him, in centre country court, that boy's friend could testify that you raped your him, and with no evidence & no witness you could be sent to prison for life. That's the precedent that centre county court has set. If you think that is kosher, God help you.
 
A retrial may not significantly affect the type and length of penalty for JS.

However, I think the real issue with the way many things were handled in this situation, was significant collateral damage and unanswered questions.

A retrial with competent counsel and reasonable timeframe may not entirely reverse the side effects for JS and others, but it should start down that path which the Paterno case and C/S/S trial should continue.

I'm sure I will be attacked for this, but I just have to ask? Why do so many of you want this rehashed? I get that many of you want what you feel is the truth. You feel it should be put on display for the public to see. However, from a PR standpoint...the best thing for PSU is to let this story die and become an ancient memory. I see no good for you coming out of this...none.
 
Dwiz. I am not a troll. Don't be an ass. I also am amazed that my post of my personal experience is removed. Not sure why but let me state again,children of neglect, abuse, and poor family situations lie. In a big way.....about the simplest things. Getting them lawyered up and putting money in front of them makes that situation all the worse. Now go ahead and remove this post since it is so controversial. And also throw in some name calling. Very disappointing.
