FC: McQueary declares impasse with Penn State in lawsuit

The emails are helpful to McQueary's case but not required. Elliot Strokoff is prepared to move forward without them to expedite the trial. They feel they have everything they need to proceed and there's no sense in dragging things out by appealing to superior court on Judge Gavin's ruling.

Selfishly, wish they'd wait on authenticating the emails.

Sounds like Strokoff just tried something to see if it would work and PSU would budget at all. When it appeared that PSU was going to drag it out and appeal, he withdrew. Wonder who is paying for Strokoff's legal fees.

Most of that type of work is done on contingency (or at least primarily on a contingency arrangement).
I do not know if that is the case here or not.....but I feel pretty comfortable in saying that it is not being funneled through any outside "third parties".
Expenses for this type of stuff, especially when dealing with an entity like PSU, and with the tendency on the part of PSU to delay/hinder the process, probably add up pretty quickly.
