Imagine having a liar like Karen Peetz, whose violation of the Board’s Standing Orders by affirmation of the Freeh Report (as pointed out by Mr. Goldsmith) ruined Penn State’s reputation and gave the NCAA the excuse it needed to impose its sanctions, brought back in so much as an advisory capacity at the request of Mr. Masser: another proven (by his own deposition in the Corman-NCAA lawsuit) liar. The same goes for Emeritus Trustees Riley, Suhey, Myers, Alexander, and Arnelle. The latter were all fired (or encouraged to not run for office again) by the alumni for very good reasons. While Garban, Surma, Hintz, and Broadhurst self-deported, they also were parties to the despicable and dishonest action shown below. Here is what all these individuals and their colleagues told the public in March 2012 about the circumstances of Coach Paterno’s dismissal.

"While Coach Paterno did his legal duty by reporting that information the next day, Sunday, March 3, to his immediate superior, the then Penn State Athletic Director Tim Curley, the Board reasonably inferred that he did not call police. We determined that his decision to do his minimum legal duty and not to do more to follow up constituted a failure of leadership by Coach Paterno. …At about 9 pm, we unanimously made the difficult decision that Coach Paterno’s failure of leadership required his removal as football coach."

This, however, is what Mr. Masser said later in a court deposition.

“The decision to remove Coach Paterno had nothing to do with what he had known, what he hadn’t done. It was based upon the distraction of having him on the sidelines would have caused the university and the current football team harm. It had nothing to do with what Coach Paterno had done, or hadn’t done.”

Kenneth “people that look like you” Frazier’s deposition, while less explicit, supports Masser’s testimony that Paterno was fired solely for public relations reasons.

If Paterno was not removed for anything he had or had not done, as affirmed under oath by Mr. Masser, he was not removed for failure of leadership. This proves unequivocally that Mr. Masser and his colleagues not only scapegoated Paterno in 2011, they then fabricated a dishonest and defamatory excuse in March 2012 to cover up their bad decision. The individuals I named above, their colleagues, Rodney Erickson (ex officio Trustee), and ex-Governor Corbett (also ex officio Trustee) were all parties to the dishonest statement in March 2012. The mere idea that anybody who has lied to and on behalf of the organization to which he or she owes a fiduciary duty should return in any capacity whatsoever is appalling.

I noticed, and responded publicly to, the letters to the editor in which Mr. Masser tried to defend the Board, and Dr. Myers accused State Senator Yudichak of seeking power at Penn State through legislative reorganization of the Board. I have provided Senator Yudichak with detailed information about the discrepancy between what these two individuals told the University and the public about the circumstances of Coach Paterno’s dismissal in March 2012, and what Mr. Masser and Mr. Frazier later said under oath.
