Incredible article. Joe would be proud of Jimmy. Basically the bank denied the allegation, but it didn’t know jimmy had recorded conversations that seem to back-up his allegations. So jimmy gave the recordings to the NY times.
I wonder how many Penn State fans wouldn’t have believed Kennedy if he didn’t have these recordings.

Good for Jimmy. Hope he makes another few million off of them for his trouble.

I'm not a lawyer, but I'm thinking leaking them prior to getting to court is likely a mistake. To any legal pros reading the board, what say you?

Well they would have
Had to produce in discovery. Probably trying to put some public pressure to help resolve out of court as quickly as possible. And of course the bank will admit to no liability. I think the strategy was probably sound.

Fair point - though, to that end, I think the reaction would be quite a bit different if the victim here was a former Pitt defensive tackle.

I'm guessing it never goes to trial -- this is just to put it out there and get pressure on the bank. The thing to keep in mind is this is just one side of the story. The bank is not presenting its side, and if they settle they may never present it. Even if the bank has a pretty good defense, defending themselves might hurt their reputation even more and cost them more clients. Heck if it just costs them a handful of former NFL players, let alone other wealthy people of color, this is a very expensive case to have hanging out there.

I just think it's cool that a Penn State football player is behind it. Cool how these guys grow up and change the world.

Um, yeah, I only read it when I saw Jimmy Kennedy's name and wondered if it was the same Jimmy Kennedy who won a lot of big games at the Beav. I'm sure the NYT was only interested because he's from Yonkers.
 
I think a lot of PSU and non-PSU fans would believe it. It’s not like banking hasn’t UD racial issues before, and the recent behavior of big banks like Wells Fargo and JPM haven’t been clothing themselves in glory lately either!

Am I wrong in wondering about the admissibility of secretly recorded conversations in court? I realize the bar is lower in civil matters, but am wondering whether this is why it was leaked to the media first.
 
In most states, only the permission of one party is required to admit a recording. So if we are talking, and I secretly tape you, I can use the tape.

If some 3d person tapes just you and me talking, he cannot use it without the permission of one of us.

I think the admissibility tracks that.

In many of these recordings, Kennedy even told the other party that he was going to be recording.

No matter, though, as AZ is a one party state.

I think this is a large reminder that despite the progress made in the last several decades, there are still a lot of examples of systemic racism in this country. So many people are quick to point the finger when we read stories about former athletes blowing through their earnings and then you read an article like this that shows the system is stacked against many that want to act responsibly with their earnings.
 
I don't know where the threshold is, but people without a big fortune ($5 to $10 mil) shouldn't be paying for private banking and luxury financial services anyway. Those people will suck a fairly large percentage of your assets every year for services that are basically what Vanguard and Fidelity do virtually for free. People who haven't had money who suddenly have money think they need people in suits to stroke their egos but very little of it is of any value.
