Judge Grants State Delay on JS Retrial Request

The state Office of the Attorney General will get more time to work on Jerry Sandusky’s Post Conviction Relief Act petition.

On Wednesday, McKean County Senior Judge John Cleland granted the OAG’s request for an extension in responding to Sandusky’s amended petition, filed May 6.

Sandusky, who was convicted of 45 counts of child sexual abuse in 2012, would like a new trial. The grounds he cites include the hasty timeline of prosecution and incompetency of counsel, specifically noting his attorneys, who told the court they were unprepared to move ahead.

Deputy Attorney General Jennifer Peterson said in her request that she only received the case April 20, and that she was “recently assigned to handle litigation in the appeals of Timothy Curley, Gary Schultz and Graham Spanier presently pending in the Superior Court.”

The state now has until Sept. 1 to respond to Sandusky’s petition.
