Judge implies Kane can release porn emails

Kane is an idiot. The ball is in her court. What has ever stopped her from charging anyone who broke the law with the emails? Most likely the people she targeted have not broken any laws. When Seth Williams called her bluff he made her look like a fool. The same will happen here.

Seth Williams has only made her look like a fool to people like you who don't understand what happened. Kane dropped the case because it had been dormant for over 6 months and there was no quid pro quo, i.e. it was an unwinable case. Kane told Williams to go ahead and prosecute it if he wants and he is moving to do so. Williams is the one who is going to look like a fool when the case is tossed before it even gets started, just like Kane told him. The only reason he called her bluff was to trick the uneducated sheep out there like you who aren't smart enough to understand that a DA can prosecute any case they want, but that doesn't mean it's winnable. This play was merely to pander to the sheep like yourself and assume that Kane would be removed from office before he ends up looking stupid for trying to prosecute an unwindable case.

I'm also not sure why you are stuck on things having to be illegal to be meaningful. The first release of e-mails resulted in multiple high ranking people being fired, removed, or resigning, including a freaking PA supreme court justice. The emails they are desperately fighting to protect are worse and involve other high ranking officials. If the first dump could remove a PA supreme court justice, I assure you, Kane will not look foolish if the second round is allowed to be released.

I'm not sure what your bias is here, but one thing is clear... you either struggle to follow facts and understand what is actually happening or you are playing dumb.

She is the AG. She had the emails all along. If she had anything she could have released them. The judge even said she does not need his permission to release them.

However Kathleen Kane, the individual, is part of a GJ investigation in which Judge Carpenter slapped her with a protective order preventing her from retaliating against current and former OAG employees who may or have testified against her.

Since you seem slow, I'll spell this out for you.... She does not need his permission to release them as AG, but as someone under a protective order, she needs his approval that she won't be in violation of his order by doing so. The moment Kane releases e-mails painting anyone who testified against her (which is pretty much everyone involved in the porn/race/religious scandal), they will claim she is retaliating and Carpenter will likely find her in violation of his order. This really isn't all that complicated.

It's a pretty smart move on the part of Fina/Carpenter and Co because the public is too stupid to understand how she can both have the legal right as AG to release the e-mails and not be able to release them as a citizen under a protective order as part of a GJ investigation. The fact that Carpenter doesn't even acknowledge this anywhere in his statements should tell you everything you need to know though. He COMPLETELY ignores the reality of her dual position and more importantly, his direct role in creating it.

Capitol Wire continues “‘The Attorney General’s office has long interpreted [Carpenter's] court order as prohibiting the release of those emails and has previously turned down Right to Know requests due to that interpretation,’ said Kane spokesman Chuck Ardo. He said Kane’s lawyers plan to file a motion to vacate Carpenter’s order next week.”

By volunteering an unjudicial and disingenuous statement, Carpenter adds credibility to the assertion that Kane’s indictment is a Republican political attack."

It amazes me that some people will actually be disappointed if she reveals that some of politicians and judges are even scummier than we ever imagined.

Actually, we know they are scumbags. So is Kane. If she had anything on them that was illegal then why didn't she do her job from the START?

Interesting comment by "anonymous" on this article (link) that may explain why fina dropped 2088 charges against the big fish to go after some minnows. It also may explain where the $30k+ worth of "unaccounted" for sting money went...perhaps fina made sure it found it's way into Ali's pocket?:

And Fina didn't think she would prosecute, even before she ever learned of the existence of the investigation. Otherwise, why would he turn over files to an FBI agentat the very moment Kane was being sworn in?

He did this, he says, because he was "concerned about a conflict of interest." Fina's previous boss, Linda Kelly - who actually knew about it - had declined to pursue the case.

Fina didn't believe Kane would prosecute. Before she took office. Yet he signed an extraordinary agreement with confidential informant Tyron B. Ali - dismissing all 2,000+ charges of fraud - on November 30, 2012. That's 24 days after Kane, whom he believed would not prosecute, was elected.

An extraordinary deal. Dismissal of more than 2,000 charges of fraud. In exchange for testimony a case that Fina believed would not be pursued. In a case his previous boss had declined to pursue.

It's looking more and more as though the case was, as editorial boards have speculated, "a 'welcome present' designed to blow up in her face."

Seth has gotten a handful of convictions of politicians using entrapment and racial profiling (e.g., all of the politicians are Black and the criminal he used to entrap them is Black) getting them for taking minor sums of money, a couple thousand dollars in cash or gifts in every case, using a party he gave clemency to who stole almost $500,000 by committing charitable fraud??? Anyone else see anything wrong with this picture - letting a person guilty of Grand Theft and Fraud of a half a million $$$s, while using the hardcore crook to entrap Black politicians for minor bribes using a "shuck-and-jive" entrapment routine? (e.g., you don't need to throw any vote you don't want to and is important to your constituents, but if it isn't important to you, will you vote the I want you to.....)

So far zero, he just offered them the deal of the century to avoid going to court. He basically dropped all the charges with the exception of the a very moonier one that even allowed them to keep their freaking pensions. Even if they had a 90% chance to win, they would be foolish to not take such a deal, especially considering all but one were already at retirement age anyway. At least one is fighting the charges though so that could be interesting....

It's truly troubling that people seem to have no issue with giving a completely free pass to someone who stole over $400,000 from PA charities in exchange for a politically motivated, targeted sting operation to catch politicians accepting a few thousand dollars.

This isn't rocket science. One doesn't need to look very far in either Philadephia or Lackawanna County (Kane's home turf) to find corrupt politicians. Whether people were white, black, green, or red, there have been numerous arrests in recent years.

At the end of the day, a number have been arrested and charged. Many of them have been found guilty and resigned their positions. I cannot understand why anyone wouldn't think that is a good thing...

It's not a "good thing" if the Attorney General is using his office to "take out" political enemies. It's only a "good thing" if the Attorney General is applying the same law to everyone.

You think that there are no GOP politicians that Corbett and Fina could've targeted with a sting for taking gifts? You think that there's no reason that they exclusively targeted black, Democratic politicians? Tom Corbett was transparently abusing the power of the OAG. That's exactly what he did when he had his hand-picked successor target Penn State starting in March 2011.

You seem to have a reading comprehension problem, because there is not one word of my post that could be construed as an "excuse" for the guys who were caught with their hands in the cookie jar.

What about the consequences for Ali, who Fina dropped ALL 2088 charges for defrauding the state out of $400K+??

Where's Seths outrage over that? Yet fina and the media want people focused on 5 democrats who collectively took less than $20K it makes zero sense. Seth/fina accused them of bribery yet they plead guilty to conflict of interest and got a slap on the wrist, i think one of them is taking it to trial (fina may even trot Ali out to testify if it does make it to trial since, you know, Ali owes fina a solid) Ya. Seth really showed them what's up...what a joke.

To put finas botched blingsting investigation in perspective, during the sting finas investigation had over $30K worth of unaccounted for state money/expenses (how fina didn't get reprimanded for that is beyond me). So, In a way fina took more from the state than the 5 philly democrats.

If finas case was so stong why did he do nothing with it for 18 months only to sandbag it via Ali's nolle pros. deal weeks before Kane took office? Why didnt linda kelly or Ryan (Kanes predecessors) prosecute it if it was so solid?

There is a difference between pleading guilty and being found guilty. Why so disingenuous?

I suppose it fools people not following closely. Maybe you see that as a good thing....fooling people.
