The clip you linked has an explanation. If you choose not to accept it that's fine, but you imply that it must be one or the other. Franklins explanation says it can be both. This is not unusual. In over 40 years of legal practice, I've seen it happen many times. I will add that when he talked to his players he was not under oath. In the pretrial hearing, he was. One final point. You say he lost you when.... Let's be honest. He didn't lose you. He never had you.
