Nirvana being sued for child pornography

If I didn’t read it myself I wouldn’t have believed it….as Mugatu said “I FEEL LIKE I’M TAKING CRAZY PILLS!”


I debated on whether or not to post this earlier. Decided against it but agree - this is bonkers. This guy re-enacted this photo every anniversary (not naked); should sue his parents.
 
Once I read this line in the article I felt like it’s clear what was going on here:

“After noting the global success of Nevermind, the suit mentions that Spencer never received any compensation for the photo”
 
Is Weird Al next? I know you can’t see anything, but he still exploited himself.

I'm not an expert and didn't even stay at a Holiday Inn Express last night but child pornography is a criminal issue not civil. If someone is found guilty of child pornography they don't payout money, they go to prison. Having said that whatever case this guy has sounds pretty weak. I suggest he try to get a football scholarship then Nirvana can pay him for any future use of his name, image and likeness.

No one in law enforcement ever saw it before, obviously.

will the parents be arrested for child pornography? Should they?

what about the people with the album cover in their possession?

would this picture be flagged as child porn on an iPhone by Apple?

And finally, if he claimed he was abused by Sandusky, how much would the PSU BOT have given him?

He is suing under a federal statute that allows for a civil action in federal court. I think he faces an uphill battle to prove that the photograph meets the statutory definition of sexually explicit material. Looks like he’s fishing for a settlement.
