The next piece of enlightenment to emerge from that endeavor will be the first.
Tim Curley and Garry Schultz will see their prison sentences end next week.
To call the entire Freeh File issue moot, would be an understatement.

As for the ongoing legal gymnastics involving Penn State University and affiliates of the Second Mile Organization, they are - at most - a series of financial deliberations regarding reimbursement. And are most certainly more charade than substance.
For better or worse, the entire feint undertaken since 2011 had no more substance than a phantasm, and existed solely with those on the periphery. All of those actually involved in the situation have long since Moved On, sparing the occasional, and increasingly infrequent, disingenuous acts of conciliation. Even the "Statue Trustees" and their advocates have faded into the mist.

I am pretty sure Paul is on record as only first hearing about JS when ganim first broke the story...... but he is friends with Joe Miller who told Paul about how he walked in on Jerry and Aaron lying down together face to face on a wrestling mat late one night. He told Paul this around the time JS was indicated a CSA. Why didn't Paul Suhey do more with the knowledge he had? Why put that in Curley's lap? Paul could have gone to the PSU police (Harmon), he could have gone to CMHS local law enforcement, he could/should have told Miller that he needed to go to Law Enforcement.....
Why didn't Paul do more? He was a Trustee. He had a responsibility even larger than Tim's in many respects.

Penn State files paperwork to sue The Second Mile

For more than five years, as Penn State’s name is repeatedly linked to law suits involving Jerry Sandusky, some people have asked one question.

What about The Second Mile?

That question may have started to be answered.

On Friday, attorneys for Penn State filed paperwork to take the first steps in a suit against the defunct charity and former executive director Jack Raykovitz. The specifics of what the university is suing for and why are not yet detailed.The Second Mile was Sandusky’s charity for at-risk youth. Sandusky was convicted of 45 of 48 counts of child sexual abuse against young boys from the charity. He is serving 30 to 60 years in state prison, but is in the midst of a Post-conviction Collateral Relief Act petition seeking a new trial or dismissal of charges.



Meanwhile, Penn State has picked up a lot of bills because of the criminal case, as well as the many other civil issues and other consequences that have spidered out from it.

The university paid $93 million in settlements to 32 claimants. There was the $60 million penalty under the NCAA sanctions, which were settled, making the final figure $48 million to the Pennsylvania Commission on Crime and Delinquency and another $12 million that stayed in-house at Penn State but dedicated to research and programming to address child maltreatment. Then there was the $8 million for the Freeh report, $2.4 million in Clery Act penalties and yet another $12.3 million that was awarded to former assistant coach Mike McQueary for his whistleblower suit.

And there are legal fees — lots and lots of legal fees.

Former FBI director Louis Freeh, in a blistering statement released after former Penn State president Graham Spanier’s conviction in March, put the total cost of the Sandusky incident at over a quart of a billion dollars

The praecipe for a writ of summons against the charity was not unexpected. Alexander Bilius, the Saul Ewing attorney who signed the paperwork, previously submitted responses to the court suggesting that such a suit would be forthcoming.

“The university hereby states that in addition to filing claims for indemnification against The Second Mile and/or its insurers, the university also may file other claims against those entities and/or against officers or members of the board of directors. ... The university reserves all rights with respect to all of the claims it may file against these entities and individuals,” Bilus told the court in 2016.

Why did he make that statement? Penn State was submitting a response to a petition of dissolution for the charity. The court acted on that in March 2016, putting all assets in the hands of the Office of the Attorney General, which said the funds came in at about $750,000.

The university followed up the statement with a proof of claims filed in July 2016.

The university issued a statement Tuesday that said it acted "in order to preserve its rights to pursue claims" against The Second Mile. It offered no additional comment.

A spokesman for the attorney general's office said the agency does not represent The Second Mile or its creditors, but rather is holding $728,000 in remaining assets while creditor claims are worked out. The only creditor that remains is Penn State.

"We are awaiting final disposition of its litigation to determine proper distribution of the escrowed funds," said Joe Grace, a spokesman for the attorney general's office.

I'm not debating Sandusky's guilt here, just the fact that the PSU 3 and JVP and PSU in general have been accused and convicted of endangering a child, while the trained child psychologist, who got the same report plus more, is still free and practicing. At the time of the McQueary boy-in-the-shower incident, if memory serves there were two narrowly-defined classes of mandatory reporter in the law: (1) licensed professionals who, in the course of practicing their profession, came in contact with an individual they reasonably believed may have been a molestation victim were required to file a report, as were (2) immediate family members, including parental paramours, who believed questionable activity may have occurred.

Note that both (1) and (2) contemplate first-person contact between reporter
and suspected victim for a report to be mandated and that no one, including potentially mandated reporters, was ever required to report hearsay no matter the source. On the other hand neither was anyone, layman or licensed professional, prohibited from making a report anytime they believed there was a need to do so for any reason.

There may have been changes in the law since 2001, haven't kept up with it, but, if there have been, I doubt any of them would require the reporting of hearsay by a teacher or anyone else.
