"There's nothing in the Constitution that says the president stops being the president in his last year"

I might also add:

There's nothing in the Constitution that says the Senate can't elect not to bring a Presidential nomination to the floor for a vote.

It is the Senate's choice to either delay or expedite the President's nomination. Not in over 180 yrs has an opposing party in the Senate chosen to push the opposing President's nomination through in an election yr. Not in over 180 yrs has the same party in the Senate not chosen to push the same party President's nomination through in an election yr. There is no hypocrisy in either of those actions. It is well-established behavior of the US Senate. And it is also not unique for the minority party to complain in both cases and then jump to the other side of the argument when the ball is in their court. If there is any hypocrisy, it is on BOTH sides of the argument.
