Tucker served to be fired with cause notice

I guess what he is saying is MSU violated the confidentiality of the investigation. how? By firing him because it went public? Who cares? I guess he sues them for that. However as I understand it, MSU did not leak it, Tracy did. He can't prove they fired him because it went public and they never rendered a decision to not fire him then reversed course so he does not know if they were headed toward firing him or not.

Also, he is saying a consensual affair does not rise to the level of being fired for cause and his point is they did nothing until it got leaked. He doesn't get to decide if he violated it or not, they do.

This is all posturing to get some of his contract money. There is no way he will get it all but now I wonder how much he can squeeze MSU for?

He is trying to create noise but at the end of the day he violated their "moral turpitude" code, no doubt about it. It does not natter that things sped up once it went public. It was not like they decided not to fire him then it went public and they fired him.

He has no good defense or "smoking gun" against them. It is clear he will fight this tooth and nail but in my opinion he has no case and should not get any money left on that contract.

What I don't like is he will end up weaseling his way to some kind of payday. It won't be $80 mil but could be $5 or $10 mil. He wants a lot more than that because he is greedy and he takes zero accountability which is ridiculous.
He doesn't deserve any money and should be paying money for being a total creep. Tracy is just as slimy as he is, by the way.

He is saying (I think) that MSU overstepped their bounds and should have had nothing to do with this since it was a consensual relationship. Essentially, yes I had an extra marital affair but that does not raise to the level of being terminated for cause.

What he and his legal team are missing is that MSU has the perogative to look at any behavior of his and judge if it violated their code of conduct. They did and he did. Moreover, he had the infamous phone sex call while traveling on MSU's dime and had the affair with a contractor he hired. This is not a relationship completely separated from his employer as he wants to portray it. In fact he had the relationship because of his employer. They are in the middle of it. On top of that he is accused of sexual harassment, no agreement by Tracy that it was consensual.

As I have said previously, I hope MSU does not capitulate to this guy and give him a big payday. In my opinion, he deserves zero, again zero of the $78 million left on his contract. He will fight tooth and nail to grovel back as much as he can. If he doesn't get anything and actually has to pay money to Tracy then his financial situation could get tenuous. Although not sure how much money he has saved so he probably is okay.

Also, who is going to hire him? His future earnings are not looking that bright. He may be done coaching and if not then stuck in D2 or D3 as a position coach. No way ever is he ever seeing money again that he got from MSU. Nothing even in the same universe as that. What a huge, huge fall from grace because of idiotic, self-centered behavior and now he is trying to justify it. Doesn't work that way Mel.

Seriously, stupid as it might be, what in the world did he do to embarrass the university other than this chick saying he whacked off while on a phone call. Come on man what have we come to? I hope he burns them big time! After the way their president acted towards PSU while Nassar did his thing, the sanctimonious Izzo during the summer of 2020, and now this. Bury Sparty!

It would be interesting to see if there's any case law for "with cause" terminations. Most cases probably end up with out of court and confidential agreements, but a few must have made it a court.
Also, MSU has to factor in the legal costs of this battle. The PR issue is huge but defending themselves will be costly.
No, I am not a lawyer, but my wife and I did pay for 2 of our kids' law degrees.

I hope they don't cave. He may play the race card or say Sparty was doing nothing until Tracy went public so they are disingenuous. There is no wrongful termination. He broke a code of behavior stipulated in a contract. Game over. Think about it, if you owned a company and had a CEO. That CEO signed a contract agreeing to a code of behavior. The first year that CEO did well and hit the objectives. The second year was a terrible year, sales down, profits down big time. Then you learn he was doing this on your company dime. On top of that you are wondering if you did make the best choice to hire him in the first place. There have to be better candidates out there. If I was the owner I would can his sorry a## and hell yes, for cause. Put aside your vitriol for Sparty and look at it objectively.

What pisses me off is if this happens in the private sector and not a high profile football coach at a major national university then the company or whatever can probably get away with paying very little if anything. But because this guy will drag things through the media and the fact that he was paid way too much money to begin with he will end up snaking his way to a good payday as in $10 million maybe. That's a joke. He has no case, none. He totally effed up and still wants all his money. He knows he won't get it all but just the mere fact he could get $10 or even $5 million is beyond absurd given what he did.

He wants that money because if he doesn't get it then he is going to need to grovel for some high school or D3 level position coach job that pays him $75 grand a year and that would be great to see. Again, you may think it is not a big deal but if this happens to an ordinary Joe, they don't get this ridiculous treatment.

Assuming the original leak did come from MSU it is probably Tucker's best angle to walk away with some cash. Argue the leak created much of the ridicule in order to enable the university to avoid paying the buyout.

My buddy was a QB at Michigan St. Over the summer he was on campus and heard the Mel and his wife were having serious issues. He was told she’s looking for a divorce. 3-4 months later, we know why.

Here is what I get least of all - neither party alleges that they ever had physical "sex" (the closest thing would be Tucker wacking-off while they were on the phone together). Their relationship was initiated as a "Professional Relationship" - as you say, even the infamous phone call where Tucker wacked-off was on a business trip in Florida (both parties were attending a conference in Florida on a Professional basis) - Tucker told MSU Investigators it was a "personal trip", but MSU Investigators have documented that this is a lie and the were both there on a business/professional basis. Tucker's entire relationship with this woman is based on his initial Professional Relationship with her - they've never had physical sex together, so how does one "consent" to being sexually harrassed by a Professional Associate who is employing you via a Consulting Contract??? Is Tucker trying to say their Business Relationship was "consensual" therefore she automatically consents to behavior which is "sexual harrassment"??? I'm truly baffled by his "she wanted it" defense - seems like a really bad defense given the circumstances.

I think it doesn't matter if it went public or not. I am not sure what their behavior policy states but I would think having an extramarital affair with a former rape victim who you hired for sexual harassment training rises to breaking that code.

yea the investigation has been completed for some time now, well before the "leak". Seems one of the big issues was his lying to or dissembling to the investigators, who had factual data (receipts etc) that made it easy to catch him in lies. (The cover up is always worse....) Wonder if the leak was a gambit to force the issue and bring to more rapid conclusion. And get out from under the salary......
 
It could be racism. No white or Hispanic coach has been fired for masturbating while on the phone with a sexual assault survivor. There's that.
