Again, another lie about Carter. Nowhere in the report does it say that Carter threatened the driver. He "blocked" his entry to driving off with Carter's probably $100k car with his forearm. This is about the 4th or 5th different lie/distortion of Carter's actions that you have made and all are describing Carter as 10x more aggressive than the actual report's language.

Why are you doing this? Do you know the tow op or tow owners? Do you not like black kids? Do you not like football players? There is some reason you keep intentionally slandering Carter here with things that the official report does not say that he did.
Believe me, I am not on the tow truck drivers side but you need to look at this completely objectively. As soon as Carter blocks the path of the tow truck driver he has committed an assault and that is a threat. What else is it? A friendly hello?

Look at it this way. Let's say you are at the store and you buy something. When you get to your car there is some 6 foot 3 250 pound guy there pissed at you and blocking your entry into your car.
The reason could be you stole his parking space or whatever. If you had a metal tire iron available then you could brandish it and be within your rights to defend yourself. The tow truck driver did not use the said weapon he flashed it like he could use it after he was threatened by Carter. Could the driver just have walked away and called the cops without breaking out a weapon? Yes of course so his behavior is not perfect but he is within his rights to defend himself once threatened.

If I am taking someone's property and they believe that I don't have the authority to do so or question the drop fee procedure and block my entry to the vehicle, then I show them evidence of the authority and drop fee procedure in official writing and if it isn't sufficient then we call authorities to resolve.

They have not committed an assault if they haven't touched me and simply have questions about how it is supposed to be resolved. That is crazy talk.

I don't try 3 different times to quickly leave the scene with the person's property.

I also don't pick up a deadly weapon and make physical threats to someone who has not touched or threatened me.

I don't understand the apologists for the criminal and irrational actions of the tow operator. Carter was wrong later in how he handled it and was charged. The tow op was also criminally wrong in making a physical threat with a deadly weapon. The tow op must be criminally charged as well.

Why don't we do an experiment? You go up to 20 random people, and put your forearm out in front of their car door as they approach it to tell them they're not leaving.

Then see what happens next. Let us know if these people get in trouble for their responses to you.

I will agree that breaking out a deadly weapon is extreme but he was threatened. Someone is blocking your way. The law favors the tow truck driver since Carter initiated it. Carter could have asked the driver for whatever he wanted and not literally blocked his way. That is where he screwed up and then he screwed up more by hurting the guy. I am not a lawyer but I don't believe the tow truck driver will be charged with anything. I know you violently disagree and believe me the whole board knows your stance on this at this point.
 
I don't know what you think happened but if a big guy physically restrains me from entering my vehicle I am "restrained" and feeling quite threatened. Especially when he is wrong and in a heightened emotional condition. Unless the article is wrong or left out key information, I've got no problem with what the driver did. And if I was on a jury, would find the same.

In my case, I have a cell phone. I call the cops. As you said that is the option he should have taken.

Also, tow truck drivers often deal with violent assholes and are often armed. They’re commonly attacked when repossessing or towing the car.

These guys know their job and what they deal with better than anyone here. I have a friend who runs a towing business. Most is a broken down vehicle situation, not illegally parking. But even he is armed.

Carter had not touched or threatened him. He blocked the guy's ability to drive off with his $100k vehicle when the tow op did not allow time for Carter to call 911 or get authorities there to clarify the authority and process. Carter tried to pay the drop fee. The guy kept hooking up the tow and attempted to flee the scene 3 separate times. At one point, he took Carter's phone.

A reasonable and the correct response from the tow op is Ok 20-year kid without much life experience, let's get local authorities here and they can explain to you the authority and process. Instead, without being touched or threatened, the tow op picks up a weapon that could kill a human and shouts threats at the young man. This is infinitely dumb and A CRIME IN THE STATE OF PA. The tow op has to be charged and he's lucky he didn't end up getting his @$$ beat with the large metal tow bar with which he threatened Carter.

Exactly. The tow op should have called the authorities and waited. Instead, he tried to take off with Carter's $100k car without giving him the opportunity to get clarification. Then he threatened Carter with a deadly weapon. He must be charged.

The law would disagree with you, as would common sense. But you stand your ground if you want.

If Carter wanted to call the police, he could have just done so. "Hey, I think some guy is stealing my car, posing as a tow truck driver ... license plate blah blah blah." Pretty simple. He chose to assault the guy and keep him from leaving (again, false imprisonment enters the picture, as well ... though that's an unlikely charge despite its potential presence here). And when the guy actually WAS leaving, Carter provided further evidence that he was assaulting the man earlier by physically attacking him.

Your link does absolutely nothing to prove or disprove your assertion. It’s not instructive on whether physically preventing someone from entering their own vehicle is a threat that rises to the level of assault.
It defines what a threat it. It has nothing to do with the vehicle.

Incorrect. He evened out the situation by presenting a weapon in defense of himself when he obviously felt threatened by a large man physically stopping him from getting into his truck to leave. Most fullest stop. No more stoppiness to be had stop.

A huge dude stopped a guy, through threat of force, from doing his job, and from vacating the premises, as he was legally entitled to do. Yes, presenting a weapon to get that person to step away so you can continue legally doing your job is "evening things out." And quite legal.

We have someone who acted illegally 3 friggin times in a span of minutes ... and another someone who just did his job, legally ... and you have folks crying that the guy who did his job is a bad guy and should be held accountable.

LOL, OK, is correct. It discusses one aspect of what a threat is.

The case it cited included a recitation of a definition of USSCt case, wherein they stated:

Critical to the resolution of our case, the Court then defined true threats, stating: True threats encompass those statements where the speaker means to communicate a serious expression of an intent to commit an act of unlawful violence to a particular individual or group of individuals. The speaker need not actually intend to carry out the threat. Rather, a prohibition on true threats protects individuals from the fear of violence and from the disruption that fear engenders, in addition to protecting people from the possibility that the threatened violence will occur. Intimidation in the constitutionally proscribable sense of the word is a type of true threat, where a speaker directs a threat to a person or group of persons with the intent of placing the victim in fear of bodily harm or death.

This was about what is protected free speech under the 1st Amendment, and what is an actual potentially actionable and/or illegal threat. Notice the discussion about intimidation. A big dude physically blocking your path out of the situation is, in every sense of the word, intimidation. This is not novel. This is settled law. Again, his actions could be considered harassment, assault and/or false imprisonment.

There is nothing in your link that would, in any way, negate the reality that stopping someone from proceeding to their car by physically getting in their way can be considered assault.

You do realize, that bar is a cinch bar that every tow truck driver uses. If he felt threatened, he has every right to defend himself. He was attacked by Carter, he was pulled out of his truck, and prevented from entering his truck. That's a misdemeanor. Furthermore, he was attacked and taken into the grass area away from his truck. Carter is no victim. You never ever put your hands on another person in this type of situation. It's got stupid written all over it.

It says, in the law of every state, and in this nation, that you are entitled to a defense of self in certain circumstances. Yes, responding to someone who is threatening battery by physically stopping you from leaving in your work vehicle by evening the odds and telling him to allow you to do your job and get out of there ... and then proceeding to try to get out of there before that same someone actually acts on his threat and rips you out of your vehicle, prohibiting you from leaving ... that's part of his "job description," as a tow truck driver, and a citizen of this country and resident of that state.

Figure. It. Out.

I hate tow truck drivers, unless they're actually coming to someone's aid. They're scummy. They're jerks. There should be other things done - other sanctions - to handle illegal parking and the such other than just getting cars towed, which is an enormous PITA to deal with, and unnecessarily expensive. But, the reality is, this guy had every right to do what he did, throughout this entire exchange ... and Carter effed up at least 3 separate times, legally.

The tow truck driver was grabbed out of his vehicle and thrown down, breaking a rib in the process. That's an attack. Just because the word "attacked" wasn't used in the official report (they wouldn't use that, of course), it doesn't mean that's not a valid and correct way to describe it.

Holy hell.

What's next ... the official report didn't say Carter was a "human being," specifically, therefore, he's not a human being?
