PA State Senator John Yudichak, 14th district, has proposed legislation to reform the Board of Trustees at Penn State.
Yudichak's proposal was prompted by the colossal governance failures - too numerous to list here - which now includes the debacle of April 9th authorizing the squandering of additional Penn State resources to pay off nebulous claims of Sandusky related plaintiffs.
Senator Yudichak's proposal addresses several systemic deficiencies, including the current BOT's:
• Complete lack of accountability
• Secretive and exclusionary processes (secretive and exclusionary even to those current Trustees who are not members of the Old Guard control group)
• Lack of engagement, where the majority of the Trustees ignore their fiduciary duties and simply rubber stamp the decisions of the elitist power brokers
• Fractionalization, whereby the control group focuses their efforts not on serving Penn State, but rather on maintaining control - at any cost to the health of the University
Senator Yudichak's proposal makes significant strides in providing for a representative form of governance that acknowledges the real stakeholders of our university.
The time for change is at hand. We now have not only the opportunity, but, in fact the MORAL OBLIGATION, to put an end to the use of Trustee seats on this Board as a means to personal reward at the expense of the students, faculty, alumni, and future of Penn State. Tyranny is not too strong a word to describe this Board's relationship to the University.
Senator Yudichak's proposal - while not perfect - is a significant step towards freeing Penn State from the grips of the cabal that has prostituted the University to whom we all owe so much.
Last year, attempts to reform the PSU BOT failed in large part because then Senate Majority Leader Dominic Pileggi (a former co-defendant of Trustee Mark Dambly) refused to allow legislation to be brought onto the senate floor for a vote.
Now, the position of Senate Majority Leader is held by Senator Jake Corman of the 34th district, a district serving State College as well as Juniata, Mifflin, and Huntingdon counties. As the Senator from the Centre Region, it is imperative that Jake Corman provides his public and enthusiastic support to this legislation - or that he propose an even better plan.
To date, Senator Corman HAS NOT come out in support of the reform proposal. [/I]
Senator Corman once said of the NCAA, "They knew where the evidence was going". Yes, and now we know where the evidence has been going. It is time for Senator Corman to provide evidence - not lip service - of his commitment to protecting the interests of Penn State, and not the interests of those who would like to see the status quo maintained and the truth hidden.
It is time to stand up and lead.
It is time to stand for real, accountable reform of the PSU Board of Trustees.
If we don't change the way the PSU BOT is composed.....we have all failed. And PSU will fail again and again.
The last time Senator Corman declared a victory for Penn State, a victory over Mark Emmert and the NCAA, the results were somewhat disconcerting.
The supposedly "voided" Consent Decree initially contained 9 penalties ..6 Punitive Penalties, and 3 Corrective Penalties.
Those penalties were as follows:
PUNITIVE PENALTIES:
1 - Waiver of transfer rules and grant-in-aid retention. THIS PENALTY HAD ALREADY EXPIRED PRIOR TO THE "SETTLEMENT"
2 - Five years of probation. REMAINS AS IS
3 - Four year post season ban. THIS PENALTY HAD ALREADY EXPIRED PRIOR TO THE "SETTLEMENT"
4 - $60 Million Fine. THIS PENALTY REMAINED AS IS AFTER THE "SETTLEMENT"...WITH EXCEPTION THAT JAKE AND THE COMMONWEALTH NOW HAVE CONTROL OVER $48 MILLION OF IT
5 - Four year reduction in grant-in-aid. THIS PENALTY HAD ALREADY EXPIRED PRIOR TO THE "SETTLEMENT"
6 - Vacation of wins since 1998. WINS WERE RESTORED TO THE RECORD BOOKS AS A RESULT OF THE "SETTLEMENT"
CORRECTIVE PENALTIES:
1 - Adoption of all recommendations from Freeh report Chapter 10. ALREADY COMPLETED PRIOR TO THE "SETTLEMENT"
2 - Implementation of Athletics Integrity Agreement. THIS PENALTY REMAINS IN PLACE
3 - Appointment of an Athletics Integrity Monitor. THIS PENALTY REMAINS IN PLACE
So, what did each party gain/lose in this devastating defeat Senator Corman dealt to the NCAA:
The NCAA:
The NCAA gave up: Ceded control (to the Commonwealth) of $48 million of the extortion fund, and reentered a line into the NCAA Football Record Book
The NCAA received: A "get out of jail free" card, along with the forced agreement from Penn State that the NCAA had acted with a "good faith interest" while extorting these penalties from the University and the Football Program.
The NCAA was clearly devastated by this defeat. (can you smell the sarcasm?)
Penn State:
Penn State gave up: Acknowledged that the NCAA acted with a "good faith interest". Authorized the legitimacy of every other aspect of the extortion known as the Consent Decree (maybe the single most devastating aspect of the settlement - but one that no one wants to talk about). Picked up yet another tab - this one for the Commonwealth's legal expenses.
Penn State received: A line back in the Football Record Book
Senator Corman:
Senator Corman gave up: Nothing
Senator Corman received: Control of $48 million of extortion funds from Penn State. The apparent ability to claim "a great victory", and the opportunity to grandstand before a gullible constituency. Senator Corman was also able to force Penn State to pick up the Commonwealth's legal expense tab, in addition to the $48 million of extortion funds from Penn State.
Every other Party at Interest:
Including Louis Freeh, the PSU BOT, every State agency responsible for Child Welfare, and every individual associated with the Second Mile
All received: Another veil of secrecy and distortion to help prevent illumination of just what exactly has been going on for the last decade(s).
If that is the definition of a victory, we can't stand to win many more battles.
