So is the AG in fact appealing the second consecutive trial court ruling dismissing the bulk of the more serious charges (e.g., manslaughter and REAP) ? Wow, unless the AG can both win the appeal AND get a new trial judge, this is going absolutely nowhere. The guy who writes this blog can't spell worth a damn, confuses vicarious negligence with contributory negligence, and appears to be a bit of a loose cannon, but his take on Tom Kline appears to be right on the money.

Kline wants a criminal court finding of negligence that he can use in his civil court case. Collateral estoppel for days, IF he can get that criminal court ruling. I think the chances of that happening are three-fold: slim, none and fat. Even if the AG wins the appeal, gets a new judge, survives the arraignment process, and goes to trial, there will be no criminal court ruling against PSU, which is the deep pocket in any civil case but not a defendant in the criminal proceeding. What a shame. Tom Kline may have to do actual work for whatever money he gets.

Interesting. So I'm still waiting for Penn State to "get their money" from Second Mile, which Tom Kline personally assured me was going to happen, when I approached him at a Drexel social event a number of years ago about Second Mile & CYS completely skating on the matter. (Note that I never asked him about "money", I only addressed holding licensed professionals accountable, which he blew off)

Josh Shapiro also blew smoke at me when he too assured me in late 2016 that he was going to investigate Second Mile when he took office.

LMAO -it's now May 2018 and it's been <crickets>.

At least Castor put together an investigative team for Second Mile, to which the General Assembly pushed Castor from office, and Bruce Beemer promptly shut down the team & destroyed files.

I am curious how Franky "Porn Fingers" Fina is going to argue for his client and against his former employer - the Attorney General.

The stench coming from the Philadelphia area in all of this is overwhelming.

I do have to agree with a lot of what is written in the below post. I can honestly say, having sat down with both Shapiro and DePasquale - Eugene and everyone else in his office I have spoken with, from his audit team, his administrative assistant, to his chief counsel - they ALL answer their phone or emails, and either answer your question or attempt to answer your question. They make the effort.

Josh Shapiro - once he took office - not so much. I am still waiting for ANYONE in his office to get back to me (even if it's just to blow me off) since last October.
