NFL to appeal

I still don't understand, given the CBA and the fact that the NFL is a business, how this became a matter for which the courts were even allowed to decide. If this is upheld it effectively neuters the NFL (whether it be Goodell or anyone following him) from being able to suspend any player for anything short of literally being caught red handed committing a crime or unequivocally breaking a defined rule.
 
I don't see anything in those articles that makes me think it'll be reversed. Can it be? Sure, anything can happen. But it's more likely than not it'll be upheld.

Businesses or individuals and businesses enter into agreements with one another all the time and end up before the courts. Let's say you enter into an agreement with a business, and that business violates the agreement. Who do you think you turn to to enforce the agreement properly? The courts of course.

This does not neuter the NFL, it just says that the NFL has to issue punishments within the rules and procedures of the agreement. They can't just willy-nilly make things up as they go in contradiction to the agreement they entered into with the players.
 
The NFL should just revoke the Patriots' franchise - tough luck, you're all gone. Goodell has the power to do that, and I'd say the damage to the NFL by repeated cheating is just cause. If nobody individually wants to take the blame, kick the whole team out.

Replace them with a new franchise in another city, and leave the Bostonians time to reflect. Listening to their excuses for years has been too much, and even soured my own impressions of the NFL.

pmjoe, you and many others seem to be forgetting the team has already been punished: A hefty fine and loss of a first round draft pick I believe. This was accepted by Kraft and not appealed.

The NFL would be gone, bankrupt, and Kraft would be very very rich
 

Care to expand? One of the articles you felt was so persuasive it was worthy of linking does nothing more than say, "on appeal, you have to convince 2 judges, not just one!!!" Wow, that settles it, the NFL wins for sure! But then to expand on the brilliant analysis, it says GOP judges will side w/ organization, dem judges will side with labor. Which ignores that it's a contract interpretation issue, which conservatives are much more likely to strictly enforce on the four corners of the document. So it stands a strong chance of finding support from judges of both parties.

As for the other link, you and the author should read the Federal Arbitration Act. It specifically allows for arbitration awards to be vacated under certain circumstances. Among them are an arbitrator acting improperly w/ the evidence, and the arbitrator exceeding his powers under the arbitration agreement. And guess what are exactly the reasons the court vacated here....
