Paniro named in ISU gambling probe

Are you a lawyer in Iowa ? Since the answer is likely NO, then I’d probably watch with all the definitive grandstanding. Funny how holy everyone seems to be all the sudden. Meanwhile their IP addresses pinging off porn sites at 3 am. And they are praying their wives don’t scour the bank accounts for their misdeeds.

I'm not a lawyer in Iowa, no, just a lawyer in NY who routinely advises on media law issues including defamation. But even if I wasn't, I'm also fully capable of asserting easily ascertainable and researchable facts about Iowa law.

Well, if the evidence was illegally obtained, the NCAA shouldn't be doling out punishment.

The two are unrelated, but I'm not disappointed that the NCAA is going a little lighter on these guys. They did what they did and can't really complain about it, but they were also victims of a LE vendetta in Iowa when this issue is clearly not unique to that state.

If you read the above posts, Paniro's situation was different. For the Iowa guys, the DA overstepped and got caught. Hence the Iowa guys are getting eligibility back. The NCAA would've never had the evidence without the DA. This is similar to the "fruit of the poison tree doctrine". You can see from post #412 why Paniro is getting reinstated.

So they got caught because an official had a vendetta is what you saying and this absolves them from breaking ncaa rules?
The NCAA got the information legally as the schools self reported the illegally obtained information. The illegal information basically can't be used in criminal proceedings anymore. They are totally separate jurisdictions end of the day obviously. The NCAA modified rules to try to make it a lot more leinient than before also. It used to be any type of gambling = a season suspension and on your own school = permanent ban.

Big question now is the potential civil lawsuit. The athletes rights were infringed on end of the day (warrantless search) and they suffered damages as a result of that. Assigning blame in court will be interesting and I will definitely be following. On one hand, the athletes still were the ones knowingly breaking the rules they are trained up on .... on the other hand, they really shouldn't have been caught.
 
Paniro's situation is a bit different than the Iowa guys.

ALL of his bets were prior to him enrolling as an NCAA athlete. It's why he's getting the slap on the wrist.

That's the weird part. If he wasn't an NCAA athlete, how can he be accountable to follow their rules. Until you agree to be bound (either explicitly or implicitly by becoming an athlete) and haven't received any compliance training, then how would you be bound?

well he still got a free yr of training!plus an xtra yr to wrestle!iowa guys so you mean both iowa and IOWA STATE?
