Jay and Kenney mainly argue that many of the issues raised in the NCAA motion were not raised in their conference discussing discovery. Specifically, nothing about Kenney was raised in the conference but is included in the filed motion. Jay and Kenney have been responsive, some things are not relevant, PSU has records they are requesting, or requested records do not exist.
My read is that the NCAA is asking for a lot of discovery materials from Jay and Kenney. Jay and Kenney are basically saying that they already delivered some, other materials are not relevant, and that the NCAA should have stated why they needed some of it in some recent hearing. I saw that Jay and Kenney are accusing the NCAA of a random fishing trip to stall and drive up costs. At least that's the quick take away from my very quick read.
