Wouldn't Tracy be an independent contractor?
Yes...but once she had a contract with MSU, she is paid by MSU. So, again, what is to say that Tucker didn't hire her just because she was sexy. I mean, it could be like hiring a hooker as your secretary just so you could pay her for the weekly "favors" with company money and not your own.

My point is, Tracy is likely not an employee. If I were the President of MSU...would I be barred from dating a gal who once officiated a field hockey game at the university? Mel is history. What he did was beyond stupid. However, I think he will do much better $$$ than many here are predicting. There are certainly questions to be asked about more than 2 dozen late night calls lasting more than 30 minutes each.
Again, I couldn't care less. Just think he will have enough feces to toss around so that 20 million will be needed to remove the stench.
 
And his Lawyer is helping him play the PR game..its over for him and MSU..would be beyond shocked if he stays and they keep him..this is all about salvaging what he can from the $95 million contract..that's all..its over..but what can he still keep $$$$..they already have Mark D I'm sure scouting for their next Coach...

I'm not a lawyer, but the claim that it was "consensual" sounds like a strawman argument to me. How does one provide "consent" for someone to make lewd and obscene come-ons to them??? Nothing has been reported that they ever engaged in physical sex - the only thing she reported was harassing behavior where Tucker would suggest he meet her at her hotel and they have sex..... that during one phone conversation he said he was masterbating while they were speaking, etc.... The argument that she never told him to stop is ridiculous - not her job to tell Mel how to behave in a professional relationship; in fact, quite the opposite is true as the University was paying her to Consult regarding potential issues within the Program related to Sexual Harrassment and Sexual Misbehavior.... She was perfectly within her bounds to let Mel reveal what a harassing unprofessional ass he is (i.e., let him hang himself). Again, how precisely would one provide "consent" to be habitually sexually-harrased in the workplace??? This sounds like a "she asked for it" defense from Tucker which is a really bad defense imho given what he is being accused of and the circumstances.
 
She is an Independent Contractor being employed by the University as a Consultant in the area of Sexual Harrassment.
If she doesn't have a retirement plan, health benefits, sick days and vacation days, it's unlikely she can be classified as an employee.
She runs her own business...and performs services for other entities.

At the end of the day, she filed a lawsuit. Had she not, he'd still be coaching. And, it appears that she kept the receipts as Tucker has admitted to a lot of what she alleged. That all triggers, probably, a clause in his contract. Open and shut. he can scream all he wants. The only money he may get is to go away. But if MSU pays him very much, there will be equal outcry as to why they paid this loser when they had him dead to rights. Women's groups will wonder why a sexual harasser is being rewarded. So they have to balance that as well.

It's a mess no doubt. Tucker has more than likely ended his career at any level of FB. But, I don't think Tracy is a winner here. I'd be reluctant to contract her services in the future. There are lots of people that can get a message across to young people without potential issues.

yep...and this is why women don't often file these charges. If she hasn't already, she'll sue Tucker. She'll end up with a couple of million but her reputation will be damaged. She will be labeled as "litigious" and why hire someone who has experience and is much more likely to sue?
 
I haven't watched Jason Whitlock for awhile so I looked him up to see what his take on this was. Wow! It's 1:47 to 11:52 but he talks slow so you can speed it up to 1.5 or so and still understand what he's saying. He talks more after 11:52 some too but the best stuff is in the timespan above.

Tucker may not get much at all. The problem is that his contract is so lucrative they could give him $1 million which is nothing in relationship to his contract but is obviously a lot of money. People could legitimately question why he gets any money from MSU. He will get some so MSU can just wrap this up quickly and not have it linger with bad PR and legal fees piling up.
This woman is shady as as all get out so she does not come away from this looking good or as a sympathetic victim.

When she has a CONTRACT with the University she is being employed by the University on a temporary basis and entitled to protections that full-time University employees are entitled to including a non-threatening, harrassment-free work environment.

Just because she is under contract employment does not mean that Tucker can treat her any way he pleases or that she doesn't have a right to a non-threatening, harrassment-free work environment.

I don't think she was working when this stuff happened. I could be wrong on that.

My discussion related to her employment status. She's an independent contractor. She was not harrassed at work. If she was harrassed it was during one of 27 late night phone calls that records show lasted more than a half hour on average.

Why are we assuming Tucker harassed her in any way? Because she says so? We've seen how that plays out sometimes.

Tucker is stupid and blew a great gig. That doesn't mean this mess is 100% his fault. Doesn't anyone question why it took Tracy 6-8 months to file a complaint? But at least she sent him a happy Father's Day text.

A large entity headed by Mel Tucker (the highest paid Executive at the University) - IOW, she was contracted by the University to work directly with Mel Tucker on this assignment... and you know the subject-matter of all these conversations was not "work-related" (which they almost certainly are as the nature of their relationship - and the only reason she would have taken the first call - was "work-related" as Tucker was designated as her point of contact to work with regarding her assignment.). BTW, you are aware that she has been working for the University since 2022 - 27 phone calls over a two year period with the head of the Department you are consulting for doesn't sound like that many calls - nor does the length of the calls seem that crazy. So when he was asking her if he could stop by her hotel later - that isn't workplace harrassment??? Really?

And how exactly does Michigan State University, a giant, bloated university like so many others, not already have the resources to educate football players about this stuff? Why do they have to hire an Officially Approved Outside Entity? Answer: It's #MeToo insurance. They can say "See, we hired this person, we're the good guys."

What exactly is this woman telling the football players that other people don't know already? Does she have some kind of portal to a secret knowledge base? No. She's telling them stuff that's common sense to an older person but younger people don't know yet sometimes because they're younger and because their hormones are raging. She's telling them, when she says no, stop. She's telling them, don't be grabby. She's telling them, even if you can get them drunk and have your way, don't do it. That kind of stuff is what she's telling them. Why in the hell does Michigan State University have to hire and outsider to say those things?

We live in a world where we can not even be polite to the opposite gender. At work there is very little conversation and that is sad. Nobody gets close or personal hardly at all. I'm a private person but I miss the days where you could interact with people and not worry about the possibility of your life being wrecked.

I'm no Spanier fan, but unfortunately modern America is filled with misinformation and conspiracy theories that is what we are fed every day. So much of our newscycles revolve around the possibilty that whatever the issue is might have the slightest possibility of possibly being true and it is then presented as "fact" on both sides of our political chasm.

The USA Today article posted by Delco above earlier today appears to be good old fashioned journalism. Tucker fibbed about enough things during the investigation that his "word" is pretty clearly questionable. He will lose this case and based on some pretty basic proven facts, he will have nobody but himself to blame.

None of the above means that Tracy is unimpeachable- but in this "he said/she said" story Mel provided enough false evidence that any impartial person can see it. Even if Tracy was more interested in a romatic relationship, Tucker should have known enough to not get his meat where he butters his bread.

So again.. have to figure she will file a civil suit against Tucker do to her inability now to find other work.. so whatever Tucker gets from MSU.. I’m sure he will end up paying some of it $$ back to Tracy.., no matter how you look at it.. and as the head Coach of a high profile program.. what a complete moron Tucker was.. makes you wonder again.. how MSU signed him to one of the biggest contracts in all of College Sports.. just insane..

While this whole thing seems all too convenient for MSU to rid themselves of Mel- he is hardly the first bigtime football coach to fall prey. Charlie Strong's dirty laundry was aired from his time at Louisville while patience was running thin in Austin. He got the boot. Interesting tidbit about Jimbo Fischer's ex having a relatiinshipvwith a former player that once revealed, ended in a quick settlement.

With roughly half US marriages ending in divorce coaches are no different than any of us. However they also l8lely are presented with more opportunities to stray due to their wealth and visibility.
