So to some folk here, the OAG acted with nothing but professionalism and the best interests of its state's citizens during the JS prosecution, but...

Here's the ploy. The charges that were dropped were all tied to Baldwin. They couldn't have her testify, so this is the latest OAG sham to try to get something on them. It's going to be hard to prove because they didn't have control over children or their activities under the control of TSM. The OAG wanted to ensure this bullshit got before a jury.
 
No, you all have been looking bad for about 6 years. I am trying to, at least, moderate that. As for "Self-Importance," the key point isn't that I did it; it is that someone associated with Penn State did it.

Well, because they probably are guilty. I would say that they are guilty of knowing that Sandusky had a "problem," and not doing anything about keeping him off campus. Further, the were not the only ones. I will note, however, that at least some of it was not illegal.

The endangering the welfare of children charge was not meant for this situation. Prior to Lynn it was always someone with a direct supervisory role over the children. Lynn expanded it some, but I don't see any way that Lynn applies here. His role was much different than theirs and he clearly had a duty. They did not that I'm aware of. The EWC and conspiracy charge are really based on failure to report I believe. Since the failure to report charge was tossed based on the Statute of Limitations, it seems to defy common sense and logic that you'd be able to maintain another criminal charge arising out of substantially the same conduct. Why have a statute of limitations in that case?

Just an fyi and this is not directed to you, just putting it out there. Each month in Dauphin County approximately 300-500 criminal cases are listed for trial and given a date. About 10 of those actually are tried that month. All of the rest are rolled over to the following month, and the month after that and so on. March is the first month this case has actually been listed for trial but the odds of it actually being tried in March are virtually non-existent. TIFWIW.

I don't get it. Why try now to push this conspiracy charge? If the OAG had incriminating shit on the PSU 3 - why not just give it to Louis Freeh to do the damage?

They gave Freeh the not so secret "secret emails" - which Freeh lied to the nation about finding. Why not just let Freeh run with the whole conspiracy thing then? It would have been game over back in 2012 - the PSU 3 could have easily been destroyed, the NCAA would have had something more concrete to grandstand about, Kane would never have been swept into office, PornGate never happens...everyone in public office would have won.

Castor told me last summer he was ready to drop the charges - but was waiting for the judge for something. I didn't quite grasp what it was. He knew the charges were crap. Josh Shapiro knows "we" think the charges are crap.

I don't get the strategy.

Freeh could not make any criminal determination. He could not prosecute.

Further, I think Freeh missed something very fundamental. Part of that was because people wouldn't talk to him and he didn't explore the leads.

Shapiro seems to want to get a conviction. Good for him.

Tom Corbett/ Frank Fina and pals could have delivered that "slam dunk" and given Freeh all the ammo to do their dirty work. If they had conspiracy shit on the PSU 3 back then, it would have been a no-brainer.

Instead, Freeh ran with 3 crummy emails that told us squat.

Bruce Beemer did more complaining about crummy emails and the possible character assassination with Gansler's review of the porn emails.

Yes, Monsignor Lynn and Sandusky.

Simple, McQueary reported it. He was not at the top of the chain of command where the decisions were being made. Hopefully, the decisions were being made above Paterno's level as well.

As for the trial time, the judge is a senior judge, so this is possibly the only case he's handling. It might come down to courtroom space.
