Not a lawyer, but my guess is that he does have a case. Especially true if he is found Not Guilty in the criminal case.
As a aside this was the issue that Joe had with Vicky. Joe felt that the team members who participated in a fight off campus deserved a fair hearing and not a kangaroo court.
 
The Constitution defines what the government can and cannot do. UW is NOT the government therefore it can't violate the kid's constitutional rights. It's like when someone has a post removed from this board and then they whine about the monitors violating First Amendment rights. There are no First Amendment rights here.

Maybe the argument could be made that UW is part of the government since it's a state university. That would be a big stretch but it only matters what one gullible judge would think
 
The investigations these universities carry out in the name of Title IX compliance are scary. You can be dismissed from school without being allowed to even testify or call witnesses. It’s a major problem.

UW is a private University? I thought it was at least like PSU, "state-related." Not sure what the courts would say if someone brought this same sort of claim at psu. Maybe the answer is already out there.

As an ironic footnote, the REASON UW has these proceedings which seem so marsupial, is attributable to a federal statute attached to their federal funding.
