Update: Paterno v. NCAA

If the Freeh report had been issued under any other name, would it have provided a greater degree of privilege for the underlying documents?

According to at least one state Superior Court judge, it might have.

During oral arguments Tuesday in Paterno v. NCAA, which focused on the discoverability of numerous documents the legal and investigative firms headed by Louis Freeh created when looking into Penn State University’s reaction to reports of sex abuse, Judge Jack Panella said several times that if the Freeh report had been issued under the Penn State banner, all of the investigative documents would have clearly been privileged.

“Why isn’t it the Penn State University trustees saying this is our report by our counsel,” Panella asked Reed Smith attorney Donna M. Doblick, who represented Penn State. “Aren’t you asking for your cake and eating it too?”

The plaintiffs’ defamation claims stem from the findings outlined in the Freeh report, which was issued publicly in 2012 following the investigation of Freeh, Sporkin & Sullivan and Freeh Group International Solutions into how Penn State handled reports of sex abuse at the hands of serial child molester Jerry Sandusky. The report was highly critical of the university and numerous school officials, including Joe Paterno, who's family members make up many of the plaintiffs in the suit.

Penn State and Pepper Hamilton, which had absorbed the Freeh firms, have fought the disclosure of numerous documents, including witness interviews, communications and analyses from the Freeh firms, contending that the documents are privileged because Freeh Sporkin had been providing legal services to the university.

However, the plaintiffs have contended that the Freeh firms had been contracted under unique circumstances and had acted completely independent of the university during the investigation, and therefore no privilege could have attached.

The panel of three Superior court judges focused much of their questioning on the precise relationship between the Freeh firms and Penn State, specifically asking about Freeh's independence in conducting the investigation and whether the services provided were outside the scope of an attorney.

“Freeh was to act with complete independence from PSU, so how can you create a privilege?,” Senior Judge Patricia Jenkins asked Doblick.

According to Doblick, the firms were providing a broad range of legal analysis and investigation, so the fact that the group was acting independent of the school did not negate the fact that the communications should be protected under attorney-client privilege.

“The Freeh report was scathing at many levels," Doblick said. “The fact that it was independent… doesn’t vitiate the communications.”

Zain Retherford Highlights

Lots of stuff to say with this one!
I hope you all enjoy this highlight video of Zain Retherford. The feedback on the Jason Nolf one was terrific and I really appreciate all your appreciation. When I made my account on BWI with the intention of uploading matches and other videos it was simply because I wanted to provide wrestling content for a great community that I have followed for quite some time.
A couple notes: The musical score for all these videos will always be something EDMish. That's just because I feel like the energy and the pace go well with the montage. If you don't like the audio feel free to mute the video and play something of your own. If you do like the music, please pump up the volume.
As far as uploading videos in the near future...My goal is to re-upload the Purdue match, re-record the Indiana match with sound and re-upload it and upload the Michigan match all by next week. I'll be at the Ohio State match at the BJC (it's going to be crazy and I can't wait), before traveling to Ithaca to watch OSU vs Cornell on Sunday, but I'll try and have the tOSU match up by Monday.

Zain Retherford's performance today...

Zain Retherford is an animal. I'd like to think he's of this world... but he's not. Alec Pantaleo did everything in his power today to slow the match down and Zain stalked him the entire length of the match and took it to him as if he took it personal that Pantaleo didn't come to participate. Zain on top pounded on a top 10 wrestler as if was child's play and we as fans of course knew what was going to happen. We've seen it with the best in the 149 weight class with seemingly... ease.

Remember that Alec Pantaleo has a build similar to Frank Molinaro, but not as big or solid. Zain out powered him, darted in for takedowns that took a millisecond to take Pantaleo to the mat and then mauled him to his back at the end of the 2nd and then rearranged his body to flatten Pantaleo on the mat at the 6:35 mark of the 3rd. Pantaleo's face and body were beaten red from the pounding Zain inflicted on him. Zain left the #6 kid in the country looking like he just got mauled. Well... he did.

Zain Retherford should be listed as a dangerous weapon on a wrestling mat. He's not of this world.

Then there was Jason Nolf and Bo Nickal. Nickal's opponent didn't make it out of the 1st and Nolf's opponent didn't look like he'd take his shoulder back to Michigan with him after the match. Brutal domination and submissive power.

Oh... and after ZPain's fall... the roof came down!!! It was so loud... the person next to me said something after the match and I didn't hear a thing... the sound in Rec Hall was that thunderous. Wow...

Nicknames

DT is "the Magic Man", Ed Ruth was "Easy Ed". Heck Zain already has a couple (Z-train or Z-pain). Is it time to give the youngsters a catchy nickname? My nominees are J-No for Nolf and "the Sheriff" for Nickal. J-No is kind of lazy, an over-used concept, but I couldn't think of anything else except "Snappy McSnapperson" for his head snaps (yes, I started that thread ,too!) which is too many syllables for a nickname. Whilst B-Nick sounds great for Bo, being a native of Texas gives us many original nickname opportunities. This is a very important subject (to me) so any assistance would be appreciated! Does anyone know if the wrestlers have nicknames for each other? That could help, too. Thanks for indulging me.

When did you know you were going to attend Penn State?

Sharing stories about just how or when or what came to mind that led you to make your decision about selecting PSU might be nice to here.

Was it your decision alone?

Did you follow your brother or sister?

Were you recruited to play a sport by Penn State?

Was their a family tradition to do so?

Did somebody help guide - school advisor wise to check out dear old state?

Or were you just drunk out of your mind and said: "Oh what the hell! PSU looks good!"

Perhaps you followed a girlfriend or boyfriend to dear old state.

Do tell please.

ICYMI: About that Oath, Judge Vermin

Much like in the case of the PSU 3, the critical evidence supporting AG Kane's perjury charges is of questionable origin.

For the PSU 3, it was emails of dubious provenance that provided the (alleged) evidence of perjury and other crimes.




Ferman's smoking gun will be undone

For Pennsylvania Attorney General (AG) Kane, it was an oath of similarly dubious provenance that is now being portrayed by the Corruption Network as the smoking gun evidence against Kane.

Another "When you went to PSU" related survey:

I lived in Tener Hall as a Freshman, and McKean as a soph and junior. So basically I was an East Halls dorm rat for all but my senior year, when I lived in Laurel Glen and the scurvy bastards took my $400 security deposit into bankruptcy with them in the Spring. Of course, given the damage we may have ( I am having a Mark Dambly moment) done to the apartment, perhaps that security deposit was a goner anyway. :)

So, fess up: were you a dorm rat, a Greek, or a Mary Tyler-Moore wannbe apt dweller?
